These Terms of Use (“Terms”) govern your use of the Modern Maps WordPress plugin (“Plugin”) and the Modern Maps Tile Proxy service (“Service”), operated by Modern Maps (“we,” “us,” or “our”).

By using the Plugin or Service, you agree to these Terms. If you do not agree, do not use the Plugin or Service.

1. Description of Service

Modern Maps provides a WordPress block plugin for embedding interactive maps. The Plugin connects to the Modern Maps Tile Proxy, a service that delivers vector map tiles, font glyphs, and sprite assets to end users’ browsers. The Tile Proxy retrieves upstream data from third-party providers including MapTiler.

2. Acceptable Use

You agree not to:

• Use the Plugin or Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Reverse engineer, decompile, or disassemble the Service or Tile Proxy.
• Resell, redistribute, or sublicense access to the Tile Proxy as a standalone service.
• Intentionally overload, disrupt, or interfere with the Service or its infrastructure.
• Use the Service in a manner that negatively impacts the experience of other users.
• Attempt to gain unauthorized access to any part of the Service or its related systems.

1. Fair Use and Rate Limiting

The Service is provided for reasonable use in connection with the Plugin. We reserve the right to throttle, restrict, or block access to the Service in cases of excessive or abusive usage, at our sole discretion. If rate limits or usage restrictions are introduced, we will make reasonable efforts to communicate them in advance.

4. Third-Party Services

The Plugin and Service rely on third-party services to function, including but not limited to:

• MapTiler (https://www.maptiler.com) for vector map tiles and font glyphs
• Komoot Photon (https://photon.komoot.io) for geocoding in the block editor
• Protomaps (https://protomaps.com) for basemap sprite and font assets
• Cloudflare (https://www.cloudflare.com) for infrastructure hosting of the Tile Proxy

Your use of the Plugin and Service is also subject to the terms and policies of these third-party providers. We are not responsible for the availability, accuracy, or practices of third-party services.

5. Intellectual Property

The Plugin source code is licensed under the GNU General Public License v2 (or later) as required by WordPress.org. This license applies to the Plugin code only. The Tile Proxy service and its infrastructure are not covered by the GPL and remain the property of Modern Maps.

6. Disclaimer of Warranties

THE PLUGIN AND SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that defects will be corrected.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MODERN MAPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE PLUGIN OR SERVICE.

8. Changes to These Terms

We may update these Terms from time to time. Changes will be posted at https://modernmapswp.com/terms with an updated “Last updated” date. Your continued use of the Plugin or Service after changes are posted constitutes acceptance of the revised Terms.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without notice.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to conflict of law principles.
